Rather than await the decision on the Affordable Care Act, President Obama decided to attack preemptively with error-filled claims about the place of judicial review in our constitutional system. Judicial review springs from the duty of a court, when deciding a case before it, to enforce the Constitution over a conflicting act of Congress.

The president took an extra week to develop his budget, but the extra time was apparently not enough to yield Medicare policies that could produce real savings. Competitive bidding offers a better solution, but only if we are willing to give it a chance.
The Administration’s growing gap between the newest defense strategy and budget makes more sense when viewed in the context of the administration’s domestic priorities. Just as President Obama wants to raise taxes on some Americans in order to pay for others, the administration is weakening America’s military strength in order to pay for expansive domestic federal programs.
